Terms of Service
These Terms of Service govern your access to and use of wits, an iOS app for fast voice capture, notes, reminders, weekly reflections, and AI-assisted thought sorting. By creating an account or continuing to use wits, you agree to these terms.
If you do not agree, do not use wits. If you use wits on behalf of another person or organization, you confirm that you have authority to accept these terms for them.
Who can use wits
You must be at least 13 years old and old enough under the laws where you live to use online services and consent to these terms. wits is not directed to children under 13.
You are responsible for keeping your Apple sign-in account and device secure and for all activity under your account.
What wits does
wits lets you record short voice captures, turn them into transcripts, notes, reminders, folders, tags, daily patterns, weekly reflections, and follow-up actions, and review or edit the results in your private workspace.
Some features are optional and permission based, including microphone recording, notifications, Calendar, Apple Reminders import, local device authentication for locked notes, Action Button launch requests, and Apple Watch capture. You can also choose to attach location details to reminders.
Your content
You keep ownership of the recordings, transcripts, notes, reminders, folders, tags, weekly reflections, and other content you put into wits. You give wits permission to host, process, transmit, copy, and display that content only as needed to provide, protect, troubleshoot, and improve the service.
You are responsible for the content you capture. Do not record or store content that you do not have the right to provide, that violates another person's privacy, or that is unlawful.
AI and reminder accuracy
wits uses AI to transcribe and organize captures. AI output can be wrong, incomplete, delayed, or surprising. You should review important notes and reminders before relying on them.
Reminder notifications, calendar displays, Watch uploads, and Action Button launches can fail because of device state, permissions, connectivity, third-party services, or operating-system limits. Do not rely on wits for emergencies, safety-critical tasks, medical decisions, legal deadlines, financial obligations, or anything where a missed or incorrect reminder could cause serious harm.
Privacy
The Privacy Policy explains what wits collects, how it is used, who it is shared with, and how you can delete or control your data. By using wits, you also agree to the Privacy Policy.
Locked notes are an in-app privacy gate that uses device authentication when available. They are not a promise that note content is end-to-end encrypted.
Acceptable use
- Do not misuse wits, interfere with the service, or try to access another person's account or data.
- Do not upload malware, abusive content, illegal content, or content that violates intellectual-property, privacy, publicity, or other rights.
- Do not reverse engineer, scrape, overload, resell, or use wits to build a competing service except where the law gives you a non-waivable right to do so.
- Do not use wits to make automated decisions about other people in a way that has legal or similarly significant effects.
Service changes
wits may add, change, suspend, or remove features. We may also set reasonable limits on storage, recording length, processing, or account access to protect the service and other users.
We may update these terms when the service, law, or business changes. If changes are material, we will take reasonable steps to notify you. Continued use after the updated effective date means you accept the updated terms.
Account deletion
You can delete your account from Settings. Account deletion is designed to remove your app data, recordings, notes, reminders, weekly reflections, folders, daily patterns, notification records, Watch capture setup data, and sign-in data, subject to technical limits and legal obligations.
We may suspend or terminate access if you violate these terms, create risk for the service or others, or if we are required to do so by law.
Ownership of wits
wits and its software, design, trademarks, branding, and service content are owned by wits or its licensors. These terms do not give you ownership of wits, only the right to use it under these terms.
Feedback you send may be used to improve wits without obligation to you, but we will not claim ownership of your personal content because you gave feedback.
No warranties
wits is provided as is and as available. To the fullest extent allowed by law, wits disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and uninterrupted operation.
Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
Liability limits
To the fullest extent allowed by law, wits will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, missed reminders, AI errors, service interruptions, or unauthorized access beyond amounts the law requires.
Nothing in these terms limits liability where the law does not allow a limit, including for intentional misconduct or non-waivable consumer rights.
Governing law
These terms are governed by the laws of the State of California and applicable U.S. federal law, excluding conflict-of-law rules, unless the laws where you live require otherwise. You and wits will try to resolve disputes informally first.
